TOWARDS A THEORY OF JUSTICE: TRADITION-INNOVATION DYNAMICS IN THE IDEA OF JUSTICE BY AMARTYA SEN 

Abstract
Amartya Sen’s The Idea of Justice offers an understanding of justice as it is to be effectively practiced in social and economic life. Highlighting the shortcomings of a theoretical method, Sen conceives of a practical, down-to-earth approach, a reasoned scrutiny of injustice, which paves the way for better realization of justice. The employment of contrasting terms such as niti and nyaya seems to be quite insufficient to take Sen’s project to its desired climax. The study offers a critique on capability approach leading to social realization, especially by challenging the prospects of public reasoning and realizational approach, and the impracticability of the consequentialist position.
